When the Hajj Badal is Nullified

Q: Hajj -32: A person performing Hajj Badal engaged in intercourse with his wife before reaching Arafat, thereby nullifying the Hajj. He then performed the Hajj again the following year. Will the Hajj Badal be valid?

Answer: Although the Hajj was nullified by the intercourse, the person was to complete the other rites of Hajj, sacrifice an animal from his personal wealth and perform the Hajj again the following year. However, this second Hajj will not be regarded as Hajj Badal, but as his own Hajj. The Hajj Badal will however be fulfilled if he then performs it the third year thereafter as Hajj Badal on behalf of the person he was supposed to have performed Hajj for.
