An Objection from a Mufti

Q: Salaah-255: A Fatwa in a previous volume of Fataawaa Raheemiyyah Stated that a person needs to repeat the Takbeer Tahreemah to begin his salaah. This leads one to believe that the person's following of the Imaam was not valid. What is then the necessity to repeat the Takbeer Tahreemah to restart the salaah since the Surah had been started already. The only factor was that the person was not following the Imaam. Please give this a thought and correct the Fatwa if necessary.

Answer: Peace be on you and thank you for the response. There is however No need to correct the Fatwa since Shaami (Vol. 1 Pg. 448) states that when a person's following of the Imaam is invalid, then his salaah had not started at all and it will not be said that he had commenced the salaah. And Allaah knows best what is most correct.
