If a Waqf house is destroyed can tree rubble be shared amongst those entitled to the Waqf? PDF Print E-mail
Kitabul Waqf [Endowment] - Definition

Question 1402) - If a Waqf house is destroyed can tree rubble be shared amongst those entitled to the Waqf?

A: The judge will use the rubble to restore the Waqf if he needs it. If he does not, he will leave the rubble until it is needed. It is not permissible to share it amongst those entitled to the Waqf.*

* Because they are oniy entitled to the benefits of the Waqf, not the substance, which is the right of Allah. The author does not mention selling the rubble. Al-Bshr al-Raiq mentions that if it cannot be used to restore the physical Waqf, it may be sold and the price obtained used for that purpose.
