Kitabul Ghasb [Usurpation] - Definition

Question 1295) - A man usurped something and claims that it perished. What is the ruling against him?

A: In principle he is supposed to return the usurped item itself. If he claims that it is perished the judge will detail him until satisfied that if it still existed he would have revealed it. The judge will then rule that he should substitute it.
