Question 2297) - If the booty has been collected, how will it be divided?

A: It will not be shared until it has been taken out of Darul Harb. Once it is in Darul Islaam the state's fifth is taken out and the remaining four-fifths is divided amongst those who have earned tire booty. According to Imaam Abu Hanifah RAH. each horseman receives two shares and each infantryman receives one share. According to Imaam Abu Yusuf RAH. and Imaam Muhammed RAH. horsemen receive three and infantrymen one. Rid* and fighters are equal. Even if the fighters meet the reinforcements in Darul Harb before the booty is taken to Darul islaam then they will share with them in it. Foreign and Arabian horses are the same. Each horseman only gets shares for one horse. camels and mules are not counted.

* Those who entered enemy lands, witnessed the participants, assisted by means of their numbers and equipment but did not get the opportunity to physically fight.
