Question 2314) - What will the Muslim army do with the Kuffar prisoners they capture?

A: The commander may execute them, enslave them or free them as Zimmis. It is not permissible to return them to Darul Harb; nor release them; nor offer them in ransom according to Imaam Abu Hanifah RAH. According to Imaam Abu Yusuf RAH. and Imaam Muhammed RAH. they may be exchanged for Muslim prisoners.
