A: The wealth in the hands of the Harbi is Fay, be it usurped wealth or Wadi'ah. The usurped wealth in the hands of a Muslim or Zimmi is Fay according to lmaam Abu Hanifah RAH. According to Imaam Muhammed RAH.* it is not Fay.
