The Takbeer Tashreeq

Q: Salaah-20: The Takbeer Tashreeq is usually recited from after the Fajr salaah of the Day of Arafah. What is the ruling concerning reciting the Takbeer Tashreeq in villages where it is not correct to perform the Eid salaah? Some people say that it should not be recited and, Behisti Zewar states that it is Waajib (compulsory) to recite it when the village is not small, but is a town or city. Should it be recited to not? please explain.

Answer: According to Imaam Abu Yusuf RAH. and Imaam Muhammad RAH. the Takbeer Tashreeq is waajib (compulsory) for every person for whom salaah is Fardh (obligatory), regardless of whether the person is male or female, a traveller or not a traveller, performing salaah in congregation or individually or in a town or village. The Fatwa is issued in accordance with this. Majaalisul Abraar (Vol.3 Pg.231) states that the Fatwa is given in accordance with this opinion because it is more cautious and caution should be exercised in maters of Ibaadah. And Allaah knows best what is most correct.
