Performing Nafl salaah after Subh Saadiq

Q: Salaah-312: Some Musallis in our Masjid perform the Tahiyyatul Masjid and Tahiyyatul Wudhu salaahs before the Sunnah and Fardh of Fajr. Is this permissible in the Shari'ah? When people stop them, they say that they are performing their Qadhaa salaah. Are they allowed to perform Qadhaa salaah at this time?

Answer: According to the Hanafi school of jurisprudence, it is not permissible to perform any salaahs such as Tahiyyatul Masjid and Tahiyyatul Wudhu from the time Subh Saadiq starts until sunrise. It is only the Sunnah and Fardh of the Fajr salaah that may be performed during this time and performing Nawaafil is not permissible. While it is permissible to perform Qadhaa salaah during this time, it should be done in private and it is forbidden to do so in front of other people. If these people truly want to perform their Qadhaa salaah, they should do so at home and not in the Masjid. And Allaah knows best what is most correct.
