The Imaam makes Salaam when the Follower Sits

Q: Salaah-333: The Imaam makes Salaam to end the salaah when the follower just calls out the Takbeer Tahreema. Should the follower sit down and stand up or just continue reciting the Qiraa'ah as he stands? If the Imaam makes Salaam just as the follower sits, must he recite the Tashahhud or stand up without reciting it?

Answer: If the Masbooq (one who joins the Imaam late) calls out the Takbeer Tahreema before the Imaam makes Salaam, he will have joined the Jamaa'ah and can start the Qiraa'ah without sitting down. However, if he calls out the Takbeer Tahreema after the Imaam says, "As Salaamu but before he says. "Alaykum", he will not be part of the Jamaa'ah. In a third instance, the Mosbooq calls out the Takbeer Tahreema and is already seated when the Imaam makes the Salaam. In this case, he will need to complete reciting the Tashahhud before standing up. However, the salaah will still be valid if he stands up without reciting the Tashahhud. And Allaah knows best what is most correct.
