Performing Sajdah Sahw without first Making Salaam

Q: Salaah-508: Our Imaam stood up for the third Rakaah of the Maghrib salaah without first sitting in Qa'dah. He was close to the Qiyaam when the Muqtadis corrected him and he sat down. He then proceeded to complete the salaah but when making the Sajdah Sahw, he failed to first make Salaam to one side. Does the salaah have to be repeated?

Answer: Sajdah Sahw did become binding in the stated case and although it is necessary to first make Salaam to one side, the salaah will not have to be repeated if this was not done. Failing to make the Salaam to one side is Makroohb Tanzeehi but does not nullify the salaah. And Allaah knows best what is most correct.
