When a Masbooq Makes the Salaam with the Imaam to End the Salaah

Q: Salaah-516: A person missed two Rakaahs with the Imaam in the Zuhr salaah, but mistakenly made Salaam with the Imaam when the Imaam ended the salaah. He then realised his error and immediately got up to complete his missed Rakaahs. Does this person have to perform Sajdah Sahw at the end of his salaah?

Answer: The follower should not make Salaam with the Imaam. If he did so in error after the Imaam's Salaam, Sajdah Sahw will be necessary, because he was no longer following the Imaam) and if he made Salaam simultaneously with the Imaam, Sajdah Sahw will not be necessary (because he is still following the Imaam at this stage and Sajdah Sahw is not necessary for an error that a follower makes). However, it rarely happens that the follower makes the Salaam before the Imaam or simultaneously with the Imaam . Sajdah Sahw will therefore be necessary in most cases. And Allaah knows best what is most correct.
