A Bequest to be Bathed, Shrouded and Buried by a Particular Person

Q: Janaa?iz-67: A dying made a bequest that a particular person should bathe him, shroud him and lead his Janaazah salaah. He has also made a bequest to be buried in a particular place. Are the heirs obliged to comply and will they be sinful if they do not?

Answer: Such types of bequests hold no status in the light of the Shari'ah because they are not the Prerogative of the deceased but of the heirs. They may decide what is best.
