Using the Bricks around Graves to Build a Wall around the graveyard

Q: Janaa'iz-76: Our graveyard is over forty years old and it had been the tradition then to build walls around the graves. By the grace of Allaah, this has stopped. The walls are being removed and the bricks and stones collected at one place. Some youngsters in the area wish to use the bricks and stones to build a wall around the graveyard. Can this be done? The graves will still be marked because only the walls surrounding them are being removed. Will this be disrespectful to the deceased? There are also one and two year old graves amongst them.

Answer: Without a doubt, it is incorrect to use baked bricks to build inside a grave without a reason valid in the Shari'ah. This is not even allowed above the grave. However, opening up the grave to remove such building material is not permissible. In fact, even if it is discovered that a dead person was not bathed. it will not be permissible to exhume the body for this purpose.

However, if the building was done on top of the grave, the stones and bricks may be removed only with the consent of the heirs and when there is no danger of conflict arising. And Allaah knows best what is most correct.
