Performing the Janaazah salaah in the Courtyard or Compound of the Masjid

Q: Janaa'iz -92: What is the ruling concerning performing the Janaazah salaah in the Masjid compound?

Answer: The Jalaazah salaah may not be performed inside the praying area of the Masjid (the area designated as the Masjid itself). It may also not be performed in the courtyard of the Masjid when the courtyard is regarded as part of the Masjid or when it is not established beyond doubt that it is not part of the Masjid. If it is established beyond doubt that it is not part of the Masjid, as is common in most places, the Janaazah salaah may be performed there.

The following question appear in Kifaayatul Mufti: Is it permissible to perform the Janaazah salaah in the Masjid? Is the courtyard of the Masjid where the Janaazah salaah is performed regarded as part of the Masjid or not? The graveyard, which is located a mile and a half away from the Masjid cannot accommodate a large Jamaa'ah, but there is a wide road outside the Masjid which can accommodate such a Jamaa'ah. Where will it be best to perform the Janaazah salaah?

The reply is as follows: It is the practicein many places to have the courtyard outside the boundaries of the Masjid. Because of this, the constructors of Masaajid generally do not include it within the Masjid boundaries. It may, however, not be performed in the countyard if it has been included within the boundaries. It will be best to perform the Janaazah salaah on the road if it will accommodate more people.
