Can the Funds Collected for a Graveyard be? Used for a Masjid or Madrassah?

Q: Janaa'iz-93: We need a graveyard in our area and have already collected the necessary funds and chosen a piece of land for the purpose. Although negotiations for the purchase had commenced, it could not be completed because of certain obstacles. While the search for alternative premises is underway, some people have taken their monies back to give it to the Masjid and Madrasah, not knowing when the land will be found. Can these funds be used for the Masjid and Madrassah? Please clarify.

Answer: The graveyard is a necessity without which there will be nowhere to bury the dead. The monies may be placed in the custody of some trustworthy person and even in a bank if there is fear of it being lost or if government regulations demand this. The collection should be continued in the meantime and the land purchased as soon as it becomes available. The monies may not be used for any other purpose. And Allaah knows best what is most correct.
