Building on Top of a Pond and using the Building for? Tailoring Classes and a Hospital

Q:-Masajid and madaaris-1: A two-storey building has been erected above the Howdh of our Masjid. The first floor has been rented out for tailoring classes, where children. possibly also young girls, learn sewing. Arrangements have also been made for the second floor to be rented out for use as an eve hospital. What is the ruling concerning this?

Answer: The Howdh is situated in the courtyard of the Masjid and such an area is designated to be used for activities related to the Masjid. The jurists have declared that it is forbidden to use this area for commerce because it violates the sanctity of the Masjid. Because the regulations applicable to the Masjid apply to the courtyard as well, it will not be permissible to rent the first floor out for tailoring classes, nor the second floor for a hospital. This will constitute a grave violation of the Masjid's sanctity. And Allaah knows best what is most correct.
