Constructing s Madrasah on Government Property

Q: Masaajid and Madaaris-6 : Is it permissible to construct a Madrasah on government property?

Answer: A Madrasah should be built on land that is owned by a Muslim who has donated the land as Waqf for a Madrasah. Alternatively, he may purchase the land and then donate it for the purpose. If there is no alternative apart from the government's property, then it is first necessary to try one's utmost to acquire the land from the government. If this does not succeed, then it may be used with the justification that just as government land is utilised for the benefit of the public, so too is the erection of a Madrasah also a benefit to the public.

Government is generally very accommodating when it concerns anything That is in the interests of the public. Therefore. even if you have no permission initially, you should start the Madrasah with the hope that permission will eventually be granted or that the land will be sold to your When this happens, the land may then be donated as Waqf And Allaah knows best what is most correct.
