An Objection to a Fatwaa in Fataawaa Raheemiyyah

Q: Miss-4: A question has passed in a previous issue of Fataawaa Raheemiyyah, asking whether the Takbeer Tahreema needs to be repeated when the Imaam makes Salaam as soon as the Masbooq calls out the Takbeer Tahreema. The reply stated that if the Takbeer Tahreema was called out before the Salaam, there will be no need to repeat it. Some Muftis object to this by saying that the person cannot be said to be a follower of the Imaam when he has not joined the Imaam in the Qa'dah.

Answer: When the Masbooq called out the Takbeer Tahreema before the Salaam with the intention of joining the Imaam, he has immediately entered into the sanctity of salaah. He will therefore be regarded as a follower of the Imaam. it is not necessary for him to physically join the Qa'dah. He will, of course, not be regarded as a follower of the Imaam if the Takbeer Tahreema was called out after the Imaam said the word, "As Salaam.

3. Answer: If the Muqtadi completed saying the Takbeer Tahreema before? the Imaam made Salaam, he will have joined the salaah and should complete the same salaah.

4. Hadhrat Mufti Azeezur Rahmaan RAH., the former Grand Mufti of Daarul Uloom Deoband was asked:

5. Q: Miss-6: When Zaid called out the Takbeer Tahreema, the Imaam made Salaam. Zaid therefore had no chance to join the Imaam in the Qa'dah. Does he have to repeat the Takbeer Tahreema or is the first Takbeer Tahreema sufficient. Answer:? He will be part of the Jamaa'ah if he called out the entire Takbeer Tahreema before the Imaam made Salaam. In this case, he will not have to repeat the Takbeer Tahreema (Shaami).
