Question 1237) - What is the meaning of Tawa? How does it arise?

A: Tawa is destruction. It arises according to Imaam Abu Hanifa RAH. in one of two ways - if the Muhtal 'alayhi denies the transfer under oath and the creditor does not have proof; on if the Muhtul 'alayhi dies bankrupt. The other two Imams add a third form of Tawa which is if the court rules that the Muhtal 'alayhi is bankrupt while still alive.
