What is the Situation when a Man Falls and Drowns in a Pond?

Q: Taharaat-10: A Musalli fell into the Masjid pond and died. Because he sustained an injury during the fall, blood flowed from his body but it did not alter the water in any way. Is the water pure or not? Some people say that all the water needs to be removed because the person died.

Answer: If a man falls and dies in a well, the water will be impure. This will however not apply to the case of water measuring an area of more than ten by ten. Such water is regarded as running water and will not be rendered impure by the death. Rasulullaah SAW. said that water is pure and cannot be renders impure by anything (unless one of its three qualities of taste, colour and smell change).

Therefore, if neither the taste, colour or smell of the water changed then the water will be pure according to all the schools of jurisprudence. It is therefore wrong to regard the pond to be impure. And Allaah knows best what is most correct.
