Assalaamu `alaykum waRahmatullahi Wabarakatoh

It is necessary for a person coming out from the state of ihr?m to cut the hair within the haram. Not doing so will render a dam (sacrifice of a goat or sheep) compulsory upon the individual.

The person will be considered to have been in the state of ihr?m until the cutting of the hair. If any act against the sanctity of ihr?m occurs, then the appropriate compensation will have to be given (sacrifice of an animal for a major act and charity for a minor act.)
Nevertheless, the ‘umra is valid.

- فصل في زمان الحلق ومكانه وشرائط جوازه - (يختص حلق الحاج بالزمان والمكان) أي عند أبي حنيفة ، ولا يختص بواحد منهما عند أبي يوسف على ما في "الهدايه" و "شرح الجامع" وغيرهما ، وذكر الكرماني والسروجي عن أبي يوسف أن الحلق يختص بالزمان ، لا بالمكان ، وعند محمد يتوقت بالمكان ، وعند زفر يتقين بالزمان لا بالمكان. (وحلق المعتمر بالمكان) أي يختص عند أبي حنيفة ومحمد ، خلافا لأبي يوسف وزفر ، وأما الزمان في حلق المعتمر فلا يتوقف بالإجماع ، (فالزمان) أي في حلق الحاج (أيام النحر الثلاثة) أي ولياليها ، (والمكان الحرم) أي للحج والعمرة . (والتخصيص) أي في التوقيت (للتضمين) أي بالدم ، (لا للتحلل ، فلو حلق ، أو قصر في غير ما توقت به ، لزمه الدم ، ولكن يحصل به التحلل في أي مكان وزمان أتى به بعد دخول وقته) أي أوان تحلله – مناسك ملا علي القاري ص 230 إدارة القرآن والعلوم الإسلامية

- فأن أخَّر المحرم حلق رأسه في حج أو عمرة حتى خرج من الحرم ، وحلق في غير الحرم فعليه دم ، خلافا لهما – المسالك في المناسك ص 751 دار البشائر الإسلامية

I have been blessed by Allah (S.W.T) with the privilege of residing in Jeddah, Saudi Arabia. Alhamdulillah I have made intention to perform my 1st Hajj this year. (May Allah (S.W.T) accept it & make it easy; Ameen). As we are in the months of Hajj now, am I able to make Umrah in these months? I was told by a friend that a person having intention for Hajj cannot perform Umrah in the months of Hajj (Shawaal, Dhul Qada and beginning of Dhul Hija) due to the fact that i will be entering and exiting Ihram. Is this valid? And if I do perform an Umrah in these months, then I will need to offer an additional sacrifice as Damm. Is this true? Note: I have made intention fro Tamattu Hajj

Assalaamu `alaykum waRahmatullahi Wabarakatoh

The rewards for performing haj are indeed very great. Nabi صلى الله عليه و سلم  said:
عن أبى هريرة قال قال رسول الله -صلى الله عليه وسلم- « من أتى هذا البيت فلم يرفث
ولم يفسق رجع كما ولدته أمه ».

Whoever visits this house (i.e. the Kaba) and does not commit any obscene acts or indecent speech he returns as the day his mother gave birth to him (free of sin).
The ruling for those who live within the boundaries of the miqat is that they are not allowed to perform tammatu haj (join haj and umrah in one journey). If they do perform tamattu, the umrah will be valid but they will be sinful for going against the commands of Shariah. Also they would have to slaughter an animal but this will not be as shukr (out of gratitude) (as is normally for the one who performs tamattu) but it will be as a compensation for his wrong doings (Jinayah).

I have two questions regarding hajj.

My mother decided to going for Hajj this year.As my father is not alive,so my brother is going with her.

My mother is 50 years old.Is it permissible for her to take medicine to stop her monthly menstrual period temporarily in the time of Hajj?

My second question is regarding my brother.He is 26 years old studying dental science.Can he do Hajj of my father as he is not alive?

It is permissible for your mother to take medicine to temporarily stop her menstruation. You should consult a doctor to avoid any health risks.

Your brother may perform Hajj on the behalf of your father. However, if he has not yet completed his own obligatory Hajj, it will be makr?h for him to perform Hajj on the behalf of another person before performing his own Hajj.

Assalaamu `alaykum waRahmatullahi Wabarakatoh

The days of Hajj are five: from the 8th of Zul-Hijjah to the 12th. There are three types of Hajj: Ifraad, Qiraan and Tamattu’. In Ifraad, one only performs the Hajj, not Umra. In Qiraan and Tamattu’ one performs both the Umra and Hajj. The only difference between Qiraan and Tamattu’ is that in Qiraan one performs both the Umra and Hajj in one Ihram, whereas in Tamattu’ after performing the Umra one changes the Ihram for Hajj. The best type of Hajj is Qiraan then Tamattu’ then Ifraad (Durr Mukhtaar, vol. 3 pg 631 Darul Ma’rifa). Although visiting Madinah and the grave of the Rasulullah (Sallallaahu Alaihi Wa Sallam) is not part of Hajj, but it is highly recommended to do so due to the ahaadith in this respect, such as the ones below:

عن ابن عمر رضي الله عنهما قال : قال رسول الله صلى الله عليه وسلم : « من حج فزار قبري بعد وفاتي كان كمن زارني في حياتي » (السنن الكبرى ، المعجم الأوسط ، المعجم الكبير ، السنن الدارقطني ، شعب الايمان)

Ibn Umar (Radiyallahu Anhu) narrates that Rasulullah (Sallallaahu Alaihi Wa Sallam) said, “He who performs Hajj then visits my grave after my death is like one who has visited me in my life.”

(As-Sunan Al-Kubra, Al-Mu’jamul Awsat, Al-Mu’jamul Kabeer, As-Sunan Ad-dara Qutni, Shu’abul Iman)

عن ابن عمر ، قال : قال رسول الله صلى الله عليه وسلم : « من زار قبري وجبت له شفاعتي » ( السنن الدارقطني ، شعب الايمان)
Ibn Umar narrates that Rasulullah (Sallallaahu Alaihi Wa Sallam) said, “My intercession is guaranteed for one who visits my grave.” )As-Sunan Ad-dara Qutni, Shu’abul Iman)
قال السـندي في حاشيته على ابن ماجه: قال الدميري فائدة زيارة النبي صلى الله عليه وسلم من أفضل الطاعات وأعظم القربات لقوله صلى الله عليه وسلم من زار قبري وجبت له شفاعتي رواه الدارقطني وغيره وصححه عبد الحق ولقوله صلى الله عليه وسلم من جاءني زائرا لا تحمله حاجة إلا زيارتي كان حقا علي أن أكون له شفيعا يوم القيامة رواه الجماعة منهم الحافظ أبو علي بن السكن في كتابه المسمى بالسنن الصحاح فهذان إمامان صححا هذين الحديثين وقولهما أولى من قول من طعن في ذلك (حاشية السندي على ابن ماجه تحت الحديث من استطاع منكم أن يموت بالمدينة فليفعل فإني أشهد لمن مات بها ؛ الرقم 3103)

Assalaamu `alaykum waRahmatullahi Wabarakatuh

At the outset, we would like to advise that involving oneself in an interest bearing loan is strictly haram and forbidden. Grave warning is mentioned in the Holy Quran regarding involvement in interest bearing transactions:


يَا أَيُّهَا الَّذِينَ آَمَنُوا اتَّقُوا اللَّهَ وَذَرُوا مَا بَقِيَ مِنَ الرِّبَا إِنْ كُنْتُمْ مُؤْمِنِينَ(278) فَإِنْ لَمْ تَفْعَلُوا فَأْذَنُوا بِحَرْبٍ مِنَ اللَّهِ وَرَسُولِهِ وَإِنْ تُبْتُمْ فَلَكُمْ رُءُوسُ أَمْوَالِكُمْ لَا تَظْلِمُونَ وَلَا تُظْلَمُونَ (279)
“O you who believe, fear Allah and give up what remains of Riba (interest), if you are truly believers. But if you do it not, then beware of war from Allah and His Messenger; and if you repent, then you shall have your principal; thus you shall not wrong nor shall you be wronged.” (Quran 2:278-279)
The Prophet (Sallallaahu alayhi wa sallam) also gave grave warnings to those who take part in interest bearing transactions. In a hadith the Prophet (Sallallaahu alayhi wa sallam) said:


عن أبي هريرة قال : قال رسول الله صلى الله عليه وسلم  « أربعة حق على الله أن لا يدخلهم الجنة ولا يذيقهم نعيمها مدمن الخمر وآكل الربا وآكل مال اليتيم بغير حق والعاق لوالديه » « هذا حديث صحيح الإسناد ولم يخرجاه وقد اتفقا على خثيم » - - المستدرك للحاكم ،كتاب البيوع ، رقم الحديث: 2220
“Four people are such that Allah will not admit them into paradise nor will they be allowed to taste its bounties. They are: one addicted to wine, one who devours interest, one who devours the wealth of the orphan without any right and one who is disobedient to his parents.”  (Mustadrak Haakim #2220)
Anything attained through interest bearing transaction will always be devoid of blessings as the Messenger (Sallallaahu alayhi wa sallam) informed us:
عن ابن مسعود رضي الله عنه عن النبي صلى الله عليه وسلم قال : « ما أكثر أحد من الربا إلا كان عاقبة أمره إلى قل » « هذا حديث صحيح الإسناد ولم يخرجاه » - المستدرك للحاكم

،كتاب الرقاق، رقم الحديث: 8006
“No one ever amasses anything from Riba except that its final outcome is loss.” (Mustadrak Haakim #8006)
Allah Ta’ala promised the same thing in the Holy Quran:


يَمْحَقُ اللَّهُ الرِّبَا وَيُرْبِي الصَّدَقَاتِ وَاللَّهُ لَا يُحِبُّ كُلَّ كَفَّارٍ أَثِيمٍ
“Allah will deprive Riba (interest) of all blessing, but will give increase for Sadaqat (charity). And Allah likes not the disbelievers and sinners.” (Quran 2:276)
The ill-effects of Riba, as mentioned in the Quranic verse above, has never been more apparent in society as it is in this modern era where interest is being exploited unlike ever before. The teachings of Islam are a shield from all kinds of vices and their evil effects, so one has to hold fast to it.

Therefore, if one is indebted with an interest bearing loan, he should constantly repent to Allah, seek his forgiveness and try his best to pay off the loan as soon as possible. He should also make a firm resolution not to engage in interest bearing transactions again.

Hajj is not obligatory on a person who is indebted when his debts exceed his assets. Therefore, one who is indebted with an interest bearing loan, should instead of spending his money on hajj (which is not obligatory on him), spend it to pay off his debt – because the longer he remains in this unlawful transaction, the more sins he will incur.
وتفسير ملك الزاد والراحلة أن يكون له مال فاضل عن حاجته ، وهو ما سوى مسكنه ولبسه وخدمه ، وأثاث بيته قدر ما يبلغه إلى مكة ذاهبا وجائيا راكبا لا ماشيا وسوى ما يقضي به ديونه ويمسك لنفقة عياله ، ومرمة مسكنه ونحوه إلى وقت انصرافه كذا في محيط السرخسي ويعتبر في نفقته ونفقة عياله الوسط من غير تبذير ، ولا تقتير كذا في التبيين والعيال من تلزمه نفقته كذا في البحر الرائق ولا يترك نفقة لما بعد إيابه في ظاهر الرواية كذا في التبيين - الفتاوى الهندية ج1 ص217 المكتبة الرشيدية

If, however, Hajj was already obligatory on you BEFORE you took the interest bearing loan and you did not perform the hajj. Then in this case you should first pay off the loan. To abstain from sin is an immediate obligation. You should prepare your will and make it known that hajj was compulsory on you and make a bequest of haj-e-badal on your behalf, should death overtakes you.

Nevertheless, should you decide to proceed for haj inspite of having an interest bearing loan, the hajj will be valid.
