Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatuh

There are two conditions which are specific for women in addition to the general conditions of haj.
It is necessary for a woman who intents to go for Haj that she is accompanied by a mahram or her husband. Mahram are those relatives with whom she cannot get married.

The second condition is that she should not be in iddat (waiting period of four months after the demise of her husband or three menstrual periods after divorce).
If any of these conditions are not found she will be excused for delaying her haj.

These conditions are according to the Hanafi madhab. Anybody following another madhab should consult an Alim of that particular madhab.

Question

I have performed umrah a couple of months ago....and one mistake which i did in the state of ihraam was...i missed a farz namaaz while travelling towrds makkah....though i had time to offer namaaz after reaching makkah...i was unmindful of it and missed it.... is that a big mistake with respect to my completion of umrah...

is my umrah complete or i have to compansate for it.

The umrah is valid. You should make Istighfaar for missing the fardh salah.

My father is after serious illness and is very feeble & unstable (needs assistance to walk). He had never visited Makkah. In keeping with his wishes, I Insha Allah intend to take him for Umra in a couple of months. Question is regarding Ihram. It would be practically difficult for my father to use the toilets in the aero-plane whilst travelling from Sri Lanka to Jeddah. To avoid the usage of toilets he would have to wear an adult Pamper. Can he wear a pamper whilst in the state of Ihram? ie, will wearing a pamper invalidate the Ihram. He would remove the pamper after reaching Makkah. And Insha Allah perform Umrah without the Pamper.May Allah shower his blessings on you for your guidance.

Assalaamu `alaykum waRahmatullahi Wabarakatuh

Many people are of the misconception that Ihram refers to the two pieces of cloth one puts on during Hajj and Umrah. In reality, it refers to the sacred state one is required to enter into, in order to fulfil the rituals of Hajj and Umrah. It is only a condition for the validity of Ihram that one puts on only such clothing that is not sewn to the shape of a human body. Wearing only two pieces of cloth is not a condition for the validity of Ihram. It will be permissible to wear only one piece of cloth or more than two pieces of cloth, as long as they are not sewn to the shape of the body and the awrah (the parts of the body that are compulsory to cover) is not exposed.

In the light of the above mentioned, it will be permissible for one to wear an adult disposable diaper, as it is not sewn to the shape of the body.

This is further supported by the ruling passed by Mufti Rasheed Ahmed Ludhyanwi, wherein he permits hernia patients to wear a langoot (a cloth generally worn by wrestlers between the legs to conceal nakedness) to avoid protrusion of intestines into the testicles.

Being in the state of purity is not a condition for the validity of Ihram. Therefore, it will be permissible for your father to travel in the state of impurity, as long as he purifies himself before engaging in any act of worship or entering the Haram.

Can somebody perform umrah in ramadan or hajj if they have an ongoing loan to pay off in small amounts that will take them the next 15 months but they will have saved enough money on the side for their umrah/hajj?

Assalaamu 'alaykum waRahmatullahi Wabarakatuh

If the loan is interest free and the person is honouring his monthly installments and paying the debt, he can save his surplus money and perform Umrah or Haj. If the loan is an interest bearing one, the person should pay out his debt as soon as possible. It is not permissible to prolong the payment of such a debt to save money for Umrah of Haj.

On my way to umrah we stopped in egypt where i had intention to put my ihram on. On reaching egypt the airline had lost my luggage  and i did not have  an ihram to put on. Having no recourse to an alim  i continued  to makkah bought an ihram locally and proceded to  the place  i think masjid Aishah  and started my umrah from there. 

Is my umrah complete or do i need do do something else for it to be valid. Please adivise jazakallah khair.

Assalaamu `alaykum waRahmatullahi Wabarakatoh

Our Fuqaha have recorded the following principle: “Any person staying out of the Meeqat (area from which it is binding to done the Ihram), intending to enter Makkah or the Haram area for any reason, whether it be for Hajj, Umrah, trade etc, it is binding upon him to don the Ihram when crossing the Meeqat, in order to express honour and respect for the Holy lands of Makkah.” Thus, a person staying out of the Meeqat area, who intends to enter Makkah, has to don an Ihram at the Meeqat. (Al-Mabsoot, vol2. pg. 152, Dar al-Fikr)

However, if a person crosses the Meeqat without donning an Ihram, he is required to return to the Meeqat and don the Ihram. If this is done, the Hajj or Umrah is complete and in order. But, if he crosses the Meeqat without an Ihram and thereafter dons the Ihram without going to the Meeqat, them his Hajj or Umrah is incomplete and he is required to “damm” ie sacrifice a goat or sheep. (Muallim al-Hujjaj, pg. 105 / Minhat al-Khaliq, vol.3 pg. 49, Makataba Rashidiya)

Therefore, when you crossed the Meeqat without an Ihram, you were required to return to the Meeqat to don your Ihram. However, you had gone to Masjid Aisha which is situated at a place called Taneem, which is not the Meeqat, rather it is the “Hill” (area within the Meeqat). Therefore, your Umrah is incomplete and you are required to give “damm” in  order to complete your Umrah.


فليس لأحد ممن يريد دخول مكة أن يجاوز الميقات إلا محرما

و لان وجوب الاحرام علي من يريد الحج و العمرة عند دخول مكة لاظهار شرف تلك البقعة

و كذالك لو اراد بمجاوزة هذه المواقيت دخول مكة لا يجوز له ان يجاوزها الا محرما سواء اراد بدخول مكة النسك من الحج او العمرة او التجارة او الحاجة اخري عندنا

ولو جاوز ميقاتا من المواقيت الخمسة يريد الحج أو العمرة فجاوزه بغير إحرام ثم عاد قبل أن يحرم وأحرم من الميقات ، وجاوزه محرما لا يجب عليه دم بالإجماع

التقييد بخروجه الي الميقات يسقط الدم الذي لزمه بمجاوزة الميقات غير محرما باالاحرام منه كما تقدم فاذا احرم من داخل الميقات لا يسقط عنه دم المجاوزة لان المتقرر عليه امران  دم المجاوزة و لزوم نسك بدخول مكة بلا احرام
