Assalaamu `alaykum waRahmatullahi Wabarakatuh

1) Lecithin itself is an emulsifier comprised of glycerol, two fatty acids, phosphoric acid and choline. It is extracted from egg yolks, soybeans or animal fats.  (IFANCA)

Therefore, if lecithin is from egg yolks or plant sources, it will be permissible. If from animal sources, it will be impermissible.

Soya Lecithin is derived from soya, which is vegetable source, so that will be permissible.

2) We are unaware of the Halaal/Haraam status of Doritos products in the U.S. However, after looking at their website it seems as though most Doritos products contain porcine enzymes. Therefore, Doritos products there should be avoided. You may verify this with a reliable ‘Alim in your area.

There is much hype around with regards to the new e cigarette that is being marketed and one of my relatives were selling these items. They say it’s a healthier alternative to smoking as all the chemicals that are found in a normal cigarette are not found in this. It works with drops that are put into the cigarette and you inhale in and release a vapour that is formed through the drops . the problem that has arisen is that some websites like wikipedia etc say that these drops are made from 4 recepies and and in one these recipies 8% alcohol is used to make this drops

So I would like to know by knowing this will it still be permissible to use this drops /e cigarette as they say by using this you stop smoking

The other argument that arose is that in cough mixture which is used for medicinal purposes there is 7% alcohol  so were is  the difference between the 2 as both are used for medicinal purposes

i would now like to know  from mufti saheb what is your view regarding the use of this device

There are two issues in your query:

  1. Ruling on electronic cigarettes
  2. Alcohol in food products

At the outset, it is important to note that electronic cigarettes are still a new product and its full health effects are still unknown.

The information in your email is incorrect, namely that an electronic cigarette is a healthier alternative to smoking and helps stop smoking.  Instead, the United States Food and Drug Administration (USFDA) “found that they contain carcinogens and toxic chemicals such as diethylene glycol, an ingredient used in antifreeze” and toxic to human beings [i].  Furthermore, health officials fear that electronic cigarettes could lead to an increase in addiction amongst young people.  Moreover, the World Health Organization (WHO) “does not consider it to be a legitimate therapy for smokers trying to quit” [ii].

Therefore, until thorough clinical studies prove otherwise, electronic cigarettes fall in the same ruling as cigarettes and, thus, are impermissible.

As for the presence of alcohol in food products, the item will be permissible to consume if:

  1. The alcohol is not derived from dates or grapes
  2. It cannot not intoxicate
  3. It is not used in vain (lahw)

If an ingredient of a certain food product meets the above conditions, then it will be permissible to consume.

وأما ما هو حلال عند عامة العلماء فهو الطلاء وهو المثلث ونبيذ التمر والزبيب فهو حلال شربه ما دون السكر لاستمراء الطعام والتداوي وللتقوى على طاعة الله تعالى لا للتلهي والمسكر منه حرام وهو القدر الذي يسكر وهو قول العامة

Assalaamu `alaykum waRahmatullahi Wabarakatuh

Since the cherries that are preserved in alcohol absorb the alcohol, it is not permissible to consume the cherries.

( وحرم الانتفاع بها ) ولو لسقي دواب أو لطين أو نظر للتلهي أو في دواء أو دهن أو طعام أو غير ذلك إلا لتخليل أو لخوف عطش بقدر الضرورة فلو زاد فسكر حد مجتبى

وإذا عجن الدقيق بالخمر وخبزه لا يؤكل ولو أكل لا يحد وكذلك لو وقعت الحنطة في الخمر لا تؤكل قبل الغسل فإن غسلت وطحنت أو لم تطحن ولم توجد رائحة الخمر ولا طعمها فلا بأس بأكله قيل هذا إذا لم تنتفخ الحنطة أما إذا انتفخت فعلى قول محمد رحمه الله تعالى لا تطهر أبدا وعلى قول أبي يوسف رحمه الله تعالى تغسل ثلاث مرات وتجفف في كل مرة وتؤكل... إذا عجن بخمر وخبز فإنه يكون نجسا ولا يطهر لأن ما في العجين من أجزاء الخمر لم يصر خلا بالخبز فلا يطهر

My question is a short one. I am a 18 year old University of Toronto Student. My family goes to Maple Lodge Farms and we buy the Zabiha Hala chicken that comes in a box ( greater quantity). We have been doing this for a while now since it is an excellent deal. The halal meat is extra cost but it is still economical. I have been doing some readings and some Imams declare it halal for the food to be cut by machine but others insist in only hand slaughtered. I know there is a big controversey going on about this topic. I would like to know if what we are buying is halal. Jazakallah khar for your time.

Can you tell me what is the verdict regarding slaughtering.

Do we have to slaughter all 4 vessels (Food Pipe - Wide Pipe &Both Jugular Veins) to regard the animal as being slaughtered Halaal according to Shariah.

Or do we only need to slaughter 3 vessels (Food Pipe - Wide Pipe & 1(Either) Jugular Vein Jugular Vein).

Assalaamu `alaykum waRahmatullahi Wabarakatuh

In an Islamic slaughter (dhabh), one cuts the trachea (windpipe), esophagus (food-pipe), and the two jugular veins.  As for the minimum amount of slaughter needed to make the animal halal, according to:

1. Imam Muhammad رحمه الله

a. It is necessary to cut majority of each of the four

2. Imam Abu Yusuf رحمه الله

a. It is necessary to cut the trachea, esophagus, and at least one jugular vein

3. Imam Abu Hanifah رحمه الله

a. It is necessary to cut any three of the four

The fatwa is on Imam Abu Hanifah’s رحمه الله view.  Therefore, as long as three of the above four vessels are cut, the slaughtering will be valid.  However, the proper and complete sunnah way of slaughtering is to cut all four.

في حالة القدرة إذا قطع الحلقوم والمرىء والودجان فقد أتم الذكاة وإن قطع الأكثر من ذلك حل أكله واختلفت الروايات في تفسير ذلك ورى الحسن عن أبي حنيفة رضي الله تعالى عنه وهو قول أبي يوسف الأول إنه إذا قطع الثلاث من الأربعة أي ثلث ما قطع فقد قطع الأكثر ثم رجع أبو يوسف عن هذا وقال يشترط قطع الحلقوم والمرىء وأحد الودجين وعن محمد رحمه الله تعالى أنه يعتبر قطع الأكثر عن كل واحد من هذه الأشياء الأربعة وعنه أيضا إذا قطع الحلقوم والمرىء والأكثر من كل الودجين يحل وما لا فلا قال مشايخنا وهو أصح الجوابات

قال رحمه الله ( وقطع الثلاث كاف ) والاكتفاء بالثلاث مطلقا هو قول الإمام وقول أبي يوسف أولا وعن أبي يوسف أنه يشترط قطع الحلقوم والمريء واحد الودجين وعن محمد لا بد من قطع الأكثر من كل واحد من هذه الأربعة وأجمعوا أنه يكتفي بقطع الأكثر من هذه العروق الأربعة

(البحر الرائق، كتاب الذبائح: 8/193؛ المعرفة)

ثم الأوداج أربعة الحلقوم والمريء والعرقان اللذان بينهما الحلقوم والمريء فإذا فرى ذلك كله فقد أتى بالذكاة بكمالها وسننها وإن فرى البعض دون البعض فعند أبي حنيفة رضي الله عنه إذا قطع أكثر الأوداج وهو ثلاثة منها أي ثلاثة كانت وترك واحدا يحل  وقال أبو يوسف رحمه الله لا يحل حتى يقطع الحلقوم والمريء وأحد العرقين وقال محمد رحمه الله لا يحل حتى يقطع من كل واحد من الأربعة أكثره

والعروق التي تقطع في الذكاة أربعة الحلقوم وهو مجرى النفس والمريء وهو مجرى الطعام والودجان وهما عرقان في جانبي الرقبة يجري فيها الدم فإن قطع كل الأربعة حلت الذبيحة وإن قطع أكثرها فكذلك عند أبي حنيفة رحمه الله تعالى وقالا لا بد من قطع الحلقوم والمريء وأحد الودجين والصحيح قول أبي حنيفة رحمه الله تعالى لما أن للأكثر حكم الكل كذا في المضمرات

( وحل ) المذبوح ( بقطع أي ثلاث منها ) إذ للأكثر حكم الكل

قال الإمام ابن عابدين في حاشيته:

قوله ( إذ للأكثر حكم الكل ) ولقوله عليه الصلاة والسلام أفر الأوداج بما شئت وهو اسم جمع وأقله الثلاث
